Two members of the Board of Nursing of the Professional Regulation Commission (PRC) were found guilty of leaking the questionnaires for the board exams in 2006, the Office of the Ombudsman said yesterday.

Ordered dismissed from the service were Anesia Buenafe-Dionisio and Virginia Diolola-Madeja, acting Ombudsman Orlando Casimiro said. Dionisio was assigned to Psychiatric Nursing while Madeja was examiner in Medical Surgery Nursing.

In the 32-page decision, the anti-graft office established that majority of Dionisio’s test questions had reached the reviewees of the RA Gapuz Review Center in Baguio City and Institute for Review and Special Studies in Manila.

“Dionisio’s defense of loss of her manuscript is self-serving and inconceivable,” according to the decision approved by the acting Ombudsman.

The anti-graft office added: “Moreover, upon learning of the loss of her copy of test questionnaires, she failed to relay the fact to the appropriate authorities.”

It also found that Madeja was liable for gross inexcusable neglect in causing the premature and unauthorized disclosure of her proposed questions.

The test questions were leaked by the examiners despite being highly confidential, the acting Ombudsman said.

It was during the time of former Ombudsman Merceditas Gutierrez when criminal charges were filed against the duo for violation of Section 15 (a) of Republic Act 8981 (An Act Modernizing the Professional Regulation Commission) and Section 3 (k) of RA 3019 (Anti-Graft and Corrupt Practices Act) before the Sandiganbayan.

The case stemmed from a complaint filed before the National Bureau of Investigation by the Professional Regulation Commission (PRC) on the alleged leakage in the June 11 and 12, 2006 Nurses Licensure Examination (NLE).

Records show a few days after the NLE, several nursing personalities complained about an alleged leakage in Baguio City after “students/reviewees, identified through their jackets, from RA Gapuz Review Center finished the examination in a shorter period of time than the others.’’

The investigation conducted by the PRC investigating committee showed that “a total of 56 situations contained in respondent Madeja’s manuscript, identified as keywords, appeared in the handwritten leakage note distributed to the reviewees of RA Gapuz Review Center in Baguio City and other parts of the country and five situations therein…with a total of 25 questions that actually came out in the NLE in the subject Medical Surgery Nursing Test.’’

The PRC report also said a total of 90 questions from Dionisio’s test were among the 100 examination questions asked in the board test in Psychiatric Nursing.

Expect delays in NBI clearances

THE NBI on Friday warned applicants to expect a delay in the processing of their clearances after Mega Data Corp., the company that had been running the bureau’s computerized clearance processing system for the past 30 years, pulled out its software and hardware when its contract expired on June 30.

But Gerry Perdido, head of the National Bureau of Investigation’s Office of the Deputy Director for Technical Services, said officials would do their best to shorten any delays in the processing of NBI clearances.

“We will use our staff to replace the system, but we will not revert to the manual system because it will cause so much inconvenience to the public,” Perdido said.

“The NBI clearance is a vital need.”

The NBI releases about 22,000 clearances daily with help from its computers.

But Mega’s contract expired without being renewed after the Justice Department’s Separate Bids and Awards Committee failed to come up with the terms of reference required for bidding out a new contract for the service in October 2009.

NBI Director Magtanggol Gatdula had earlier said five firms joined the bidding: V.G. Roxas and Co Inc., Mega Data Corp., Total Information Management, Systems and Plan Integrator and Development Corp., and Data Trail Corp. But he said the Awards Committee issued a resolution on Sept. 27 last year declaring a failure of bidding.

Mega had been providing the NBI various computers, data capture, image capture and card production equipment and supplies to serve the bureau’s data-processing needs.

In a media advisory released yesterday, however, deputy director for Technical Services Rey Esmeralda said the bureau would be using a different system.

“We ask the public to bear with us during the transition state of our operations,” Esmeralda said.

He said applications for clearances would again be entertained on July 4 after the bureau stopped accepting them Friday. Macon Ramos-Araneta

PRC REGISTRATION FORMS WITHOUT EXAMINATION for Real Estate Service Practioners Now Available

All real estate service practitioners may now download the PRC Registration Forms without Examination for Real Estate Service Practitioners.

Under Republic Act No. 9646, and the Implementing Rules and Regulations of RA 9646, certain real estate service practitioners will be allowed to register without examination, as provided in Sec. 20 of the IRR of RA 9646, as follows:

SEC. 20. Registration Without Examination. Upon application and payment of the required fees, the following shall be registered, and shall be issued by the Board and the Commission a certificate of registration and a professional identification card without taking the prescribed examination:

(a) Those whose, on the date of the effectivity of R.A. No. 9646 or as of 30 July 2009, are already licensed as real estate brokers, real estate appraisers or real estate consultants by the Department of Trade and Industry (DTI) by virtue of Ministry Order No. 39, as amended: Provided, that they are in active practice as real estate brokers, real estate appraisers, and real estate consultants, and that they have undertaken relevant Continuing Professional Education (CPE) or Continuing Education Program (CEP) to the satisfaction of the Board: Provided, further, that the following practitioners shall be allowed to register:

1. Any holder of a valid DTI license who has earned fifteen (15) Continuing Education Program (CEP) or CPE credit units;

2. Those who had failed to renew their DTI License prior to 30 July 2009 but who have earned twenty-four (24) CEP credit units from accredited service providers as per M.O. 39 or CPE credit units from CPE Council Accredited Provider from 2007 to July 30, 2011;

3. Those who had passed the 2009 & 2008 licensure examinations given by the DTI but who had failed to obtain their license upon the effectivity of the R.A. No. 9646 and who have earned fifteen (15) CEP or CPE credit units;

4. Those who had passed the 2007 licensure examinations given by the DTI but who had failed to obtain their license upon the effectivity of the R.A. No. 9646 and who have earned eighteen (18) CEP or CPE credit units;

5. Those who had passed the DTI licensure examinations in 2006 and prior years but who had failed to obtain their license upon the effectivity of R.A .No. 9646 and who have earned one hundred twenty (120) CEP or CPE credit units;

Provided, finally, that real estate practitioners falling under the above-described categories who fail to comply with the necessary CPE requirements within two (2) years after the effectivity of R.A. No. 9646, on or before 30 July 2011, shall be required to take the Board licensure examination for real estate service practitioners;

(b) Assessors and appraisers who, on the date of the effectivity of R.A. No. 9646 or as of 30 July 2009, hold permanent appointments and are performing actual appraisal and assessment functions for the last five (5) years, have passed the Real Property Assessing Officer (RPAO) examination conducted and administered by the Civil Service Commission (CSC) in coordination with the Department of Finance (DOF), and have undertaken relevant CPE to the satisfaction of the Board; and

(c) Assessors and appraisers who, on the date of the effectivity of R.A. No. 9646 or as of 30 July 2009, hold permanent appointments and have at least ten (10) years actual experience in real property appraisal or assessment and have completed at least one hundred twenty (120) hours of accredited training on real property appraisal conducted by national or international appraisal organizations or institutions/entities, duly certified by the Department of Finance (DOF) or any other pertinent national government agencies or Government Owned and Controlled Corporations (GOCC) as the case may be, recognized by the Board and relevant CPE credit units to the satisfaction of the Board.

Those falling under categories (b) and (c) shall register with the Board after they shall have complied with the requirements for registration as real estate appraisers, and have completed twenty four (24) CPE credit units. Provided, that those seeking to be licensed to a new credential level shall be required to take the pertinent Board licensure examination for real estate service practitioners.

Those so exempt under the aforementioned categories shall file their application within two (2) years from the effectivity of Republic Act No. 9646 or until 30 July 2011. Provided, that the renewal of the professional identification card is subject to the provisions of Section 17, Art. III of R. A. No. 9646.

An applicant for registration without examination must submit the following documents:

1. Original and photocopy of Certificate of Live Birth / Birth Certificate (NSO), or valid Philippine passport, or any other proof of citizenship;

2. Original and photocopy of Certificate of Registration (COR) and / or Professional Identification Card (PIC) or DTI Licenses;

3. DTI Certification of Rating (for those who passed the examinations but failed to obtain their license),

4. Original and photocopy of NBI Clearance,

5. Duly notarized CEP/CPE Certification,

6. Civil Service Commission Certification, DOF, or any other national government agencies, or GOCC Certification (assessors or government appraisers), or any certification of accredited seminar/training provider,

7. Appointment papers and service records to prove appraisal or assessment experience (for assessors or government appraisers),

8. Original and photocopy of Marriage Certificate / Contract of Marriage (NSO) (if applicable),

9. Four (4) passport size colored photos with complete nametag in white background, original and photocopy of community tax certificate (CTC), and surety bond for Real estate brokers and private real estate appraisers.

IRR of RESA PUBLISHED

IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 9646 published

Finally, the Implementing Rules and Regulations of Republic Act No. 9646 was published last Saturday, July 23, 2010 in the Philippine Daily Inquirer and the Philippine Star.

The publication finally ended the period of long waiting by the real estate service practitioners, for the reason that under the Real Estate Service Act of the Philippines, Republic Act No. 9646, the implementing rules and regulations had to be promulgated before the law could really be fully implemented.

PRB-RES to Finalize IRR of RESA

CONSULTATIVE DRAFT OF IMPLEMENTING RULES AND REGULATIONS OF THE REAL ESTATE SERVICE ACT issued by the Professional Regulatory Board of Real Estate Service [ PRB-RES ]

The Professional Regulatory Board of Real Estate Service, PRB-RES, after the NCR-Luzon public hearing held last June 9, 2010 where various stakeholders in the real estate service industry were invited has requested all those who have comments on the proposed provisions of the Implementing Rules and Regulations of the Real Estate Service Act [ RESA, RA 9646 ] to submit their comments within three (3) days as the PRB-RES hopes to finalize and hopefully be published and become effective July 2010.

So far, the PRB-RES has conducted public hearings in Cagayan de Oro and Cebu and the last having been held for NCR-Luzon last June 9, 2010.

The PRB-RES is working hard on the finalization of the implementing rules and regulations and hopes to finish the same and have the IRR published and effective by July 2010.

CONSULTATIVE DRAFT OF IMPLEMENTING RULES AND REGULATIONS OF THE REAL ESTATE SERVICE ACT issued by the Professional Regulatory Board of Real Estate Service [ PRB-RES ]

The Professional Regulatory Board of Real Estate Service, PRB-RES, has issued a consultative draft of the Implementing Rules and Regulations of the Real Estate Service Act [ RESA, RA 9646 ] which is intended to be the basis for discussions during the public hearings and consultations with various stakeholders.

So far, the PRB-RES has conducted public hearings in Cagayan de Oro and Cebu and is scheduled to have another public hearing in the NCR Area, which has been set on June 8, 2010, although details will still have to be announced.

The PRB-RES is working hard on the finalization of the implementing rules and regulations and hopes to finish the same and have the IRR published and effective by July 2010.

The first Professional Regulatory Board of Real Estate Service [ PRBRES ] was finally created with the members thereof being inducted at oathtaking ceremonies held at the Professional Regulation Commission last Friday, 26th March 2010 at the PRC Office.

The Professional Regulatory Board of Real Estate Service is composed of the following:

Under Sec. 4, Article II of the Real Estate Service Act of the Philippines, the Professional Regulatory Board shall be created, as follows:

"SEC. 4. Creation and Composition of the Board. – There is hereby created a Professional Regulatory Board of Real Estate Service, hereinafter referred to as the Board, under the supervision and administrative control of the Professional Regulation Commission (PRC), hereinafter referred to as the Commission, composed of a chairperson and four (4) members who shall be appointed by the President of the Philippines from the three (3) recommendees chosen by the Commission from a list of five (5) nominees per position submitted by the accredited and integrated professional organization of real estate service practitioners: Provided, That two (2) of the members of the Board shall represent the government assessors and appraisers.

The first Board shall be organized within six (6) months from the effectivity of this Act."

As the RESA became effective last July 29, 2009, the Board should have been formed last January 2010 as the law provided that the first Board shall be organized within six (6) months from its effectivity. Notwithstanding the delay in the creation of the first Board, the final creation of the PREBRES is a welcome move as the real estate service industry has practically been at a standstill pending the creation of the Real Estate Service Board.

The first major task of the Real Estate Service Board is really to come up with the implementing rules and regulations to implement the Real Estate Service Act [ Implementing Rules and Regulations, RESA RA 9646 ] in order to guide the real estate service industry as to the implementation of the RESA.

Osmeña: Enforcing the Real Estate Service Act

THE Real Estate Service Act (RA 9646) regulates the practice of real estate service in the Philippines and creates the Professional Regulatory Board of Real Estate Service (PRB-RES).

The PRB-RES shall implement the law, under the supervision and administrative control of the Professional Regulation Commission (PRC). But apparently, even if the law was enacted last June 29, 2002 yet, the unlicensed real estate practitioners continue to proliferate in servicing Cebu’s land developers. They offer commercial, residential and condo units to prospective buyers and earn hefty commissions.

Today, land developers and real estate brokers continue to violate RA 9646. The PRB-RES has the duty to finally eradicate the practice of unauthorized or unlicensed individuals, exercising its quasi-judicial administrative powers.

But the question legitimate licensed brokers are asking is, when? Article 5, section 41 states that within 90 days from the effectivity of the law, the DTI-Bureau of Trade Regulation and Consumer Protection (BTRCP) is required to transfer all pertinent records, documents and other materials to the Professional Regulatory Board of Real Estate Service.

“Likewise, the commission, together with the board and the accredited and integrated professional organization of real estate service practitioners, the Department of Finance, and the Commission on Higher Education, shall prepare the necessary rules and regulations,” the law states.

Critics argue that it took over five decades to professionalize the practice of real estate and what is worrisome is it might take a few more decades to implement the necessary rules and regulations.

Since the members of PRB-RES are all presidential appointees, there is a need for real estate practitioners such as the Pareb-Cereb organization to lobby for President Gloria Arroyo to fast-track its implementation.

Thousands of real estate brokers and salesmen throughout the country are waiting for the Professional Regulatory Board of Real Estate Service to perform its functions.

These include providing comprehensive policy guidelines for the promotion and development of the real estate industry; conducting licensure examinations for the practice of the real estate service profession; and issuing, suspending, revoking or reinstating, after due notice and hearing, certificates of registration or professional identification cards for the practice of real estate service.

The PRB-RES is also supposed to safeguard legitimate and licensed real estate service practitioners and, in coordination with the accredited and integrated professional organization of real estate practitioners, monitor all forms of advertisements, announcements, signboards, billboards, pamphlets, brochures and other similar nature concerning real estate.

The board has many other powers and functions but what needs to be emphasized now are the penal provisions and supervision of real estate salespersons.

In case the violation is committed by a partnership, corporation, association or any judicial person, the partner, president, director or manager who committed, consented to or knowingly tolerated unlicensed real estate practitioners, face a penalty of P200,000 or imprisonment of not less than four years. Both the fine and imprisonment may be imposed, upon the discretion of the court.

Real estate salespersons shall be under the direct supervision and accountability of a real estate broker.

A real estate broker shall be guilty of violating the law if he or she employs a salesperson who has not secured the required accreditation from the board.

RA 9646 explicitly prohibits realty developers from employing unlicensed real estate salespersons in the marketing of products. I hope the Pareb-Cereb member-practitioners shall be responsive and help stop “colorum” real estate practitioners.

Industry prepares for professionalization

MANILA, Philippines - The local real estate industry may soon finally have a Professional Regulatory Board of Real Estate Service (PRBRES) under the supervision and administrative control of the Professional Regulation Commission (PRC).

Barring any unforeseen circumstance, its charter members of the board and the chairman will be inducted today, March 26, 2010.

The real estate industry, particularly the working sales people such as brokers, sales personnel who are all in the forefront of the lifeblood of property development and real estate sales transactions are all waiting in earnest as to how the newly established body will act on the current problems concerning the licensure procedure of those individuals and companies involved in the selling of real properties in the country.

On June 29 of last year, Republic Act 9646, or now more commonly referred to as the Real Estate Service Act (RESA) was signed into law.

This new ruling basically requires all real-estate service practitioners to be licensed and registered with the Professional Regulatory Board of Real Estate Service,which is under the supervision and administrative control of the Professional Regulation Commission.

Conversely, the new law intends to protect the buyers, even before they get involved in a real-estate transaction, by assuring them that they are only dealing with competent, professional, duly licensed and registered practitioners whose standards of practice and service shall be globally competitive and who are subject to stiff penalties for certain violations and malpractice.

Prior to the effectivity of this law, these licenses were secured only from the office of the Department of Trade and Industry (DTI). Except for the real-estate salesperson, all levels, meaning the broker, appraiser, consultant and assessor are required to undergo examinations to be given by the board as a prerequisite to licensure and registration.

However, a real-estate salesperson is still required to secure a license and can only work under a licensed broker who will have to be a signatory in all the transactions of the salesperson.

For almost three years now, a good number of real estate practitioners have failed to renew their real estate broker’s license for the simple reason that the Implementing Rules and Regulation of the new law has not been prepared yet.

The issue has caused a lot of confusion among real estate practitioners all over the country.

In an exclusive interview with the Star, Alejandro Manalac, a three-term National President of National Real Estate Association (NREA), a leading real estate organization in the country and currently the vice president for sales of businessman Lucio Tan’s ETON Properties, gave some insights into this issue:

PS: In your opinion what do you propose that the newly formed board should do to address this issue?

Alejandro S. Manalac: Once this board gets to work, the first thing on their work pads will be the drafting of the Implementing rules and regulations (IRR) which should give clarity to all the vague provisions of this law that caused a lot of worries to a lot of practitioners (whether licensed, candidates for licensing or “colorum” agents as referred to by the brokers). Right now, these practitioners, especially those who are not updated with the current status of RESA, are in limbo as to when, where and how they can renew their expired licenses.

PS: Can you explain exactly the real intention of this law?

ASM: As a whole, the intention of this law is very well appreciated by the industry. It is just that it came like a thief in the night which caught everyone by surprise except for some quarters which really pushed for this for their own benefit. The basic idea as stated in the Declaration of Policy in Article I, section 2. ....”Hence, it shall develop and nurture through proper and effective regulation and supervision a corps of technically competent, responsible and respected professional real estate service practitioners whose standards of practice and service shall be globally competitive and will promote the growth of the industry”, is to professionalize the industry of real estate.

PS: What particular provision of this new law that caused a stir? And why?

ASM: “The only 2 provisions which really caused quite a stir in the circles of developers are sections 31 and 32 of Article IV which covers the Practice of Real Estate Service. Section 31 is about the Supervision of Real Estate Salespersons. Section 32 is what really alarmed the developers and most of all, their in-house sales people.

This section which is about the Corporate Practice of the Real Estate Service which has been perceived to be still very vague and thus subject to interpretations will definitely be first on the agenda of this august board. This is the provision which will have the biggest effect on the operations of corporations involved in marketing and selling of Real estate development projects.

Many ‘old timers’ who have climbed up the corporate ladder in their respective sales organizations who now heads big sales teams but do not have a Real Estate Broker’s License may even be displaced . What makes it worse is if they do not have College degrees and thus could not even be qualified to take the exams.

PS: Were you not consulted by members of Congress at a time that the law is being deliberated upon in the House and Senate?

ASM: Yes and No. Why because we submitted all our position papers while this law is being hatched in Congress but the passage of this law became so swift that we were not given some more chance to press our major concerns.

Industry workers were practically caught by surprise when this act was signed into law. The surprise turned into fear when they learned about the limiting provisions of this law. This fear turned into anger when they realized that they were practically “cornered” by this law, seemingly helpless at present since there were no provisions for a smooth transition.

These people I am referring to are the in-house sales people of most of the bigger developers. They have the impression that they are being forced into a situation where they have no choice but to turn to the few licensed brokers who were fortunate enough to renew their licenses just before the deadline last June.

PS: What’s the general feeling of property developers with regards to the fast-tracking of the RESA law?

ASM: Most developers feel that this law, with all its good intentions, only favors the existing active licensed real-estate brokers now but have neglected the existence and importance of the in-house sales organizations who are actually the ones who have played a major role in bringing Philippine real estate to where it is right now.

PS: Will the industry players be given the chance to assist in the formulation of the IRR?

If so how?

ASM: We are all hoping that we’d be given the chance this time. The real estate industry as a whole is confident that we’d all be given the chance to come up with a win-win scenario especially for the sales personnel and brokers concerned.

For the past several months, I have been involved in a series of discussions with different real estate organizations and developer associations who have come up with a lot of bright ideas on how to go about the transition as smooth as possible to ease the ‘birth pains’ of professionalizing the practice of real estate selling. These ideas will definitely be valuable inputs that will help in the faster and more objective drafting of the IRR so that everybody can already move on.

“Pending the appointment of the Chairman and Members of the Professional Regulatory Board of Real Estate Service (PRBRES), pursuant to Republic Act No. 9646, all Real Estate Brokers, Real Estate Appraisers and Real Estate Consultants, whose licenses issued by the Department of Trade and Industry (DTI) expired on December 31, 2008 and onwards, are required to file their application for registration without examination under Section 20, Article III of R.A. No. 9644 [sic? 9646] from January 12, 2010 to July 30, 2011, stamped received by the Professional Regulation Commission and/or the PRBRES. Creation of Real Estate Service Board Goes Underway

The Professional Regulation Commission has started the process for the eventual

creation of the initial Professional Regulatory Board of Real Estate Service.

Under the Real Estate Service Act of the Philippines, R.A. 9646, it is provided that:

“SEC. 4. Creation and Composition of the Board. – There is hereby created a Professional Regulatory Board of Real Estate Service, hereinafter referred to as the Board, under the supervision and administrative control of the Professional Regulation Commission (PRC), hereinafter referred to as the Commission, composed of a chairperson and four (4) members who shall be appointed by the President of the Philippines from the three (3) recommendees chosen by the Commission from a list of five (5) nominees per position submitted by the accredited and integrated professional organization of real estate service practitioners: Provided, That two (2) of the members of the Board shall represent the government assessors and appraisers. [ Sec. 4, Article II, RA 9646 ]

The first Board shall be organized within six (6) months from the effectivity of this Act.”

However, although Real Estate Service Act has become effective last July 30, 2009, it was only sometime last November 2009 that the process of creating the Board finally got a boost in the arm towards its eventual creation.

Its crucial importance lies in the fact that the first step before the law can be fully implemented is to promulgate the implementing rules and regulations. However, the Real Estate Service Board shall be the one to undertake the preparation of the implementing rules and regulations with the Commission, as provided under Sec. 42 of RA 9646, as follows:

"SEC. 42. Implementing Rules and Regulations. – Within six (6) months after the effectivity of this Act, the Commission, together with the Board and the accredited and integrated professional organization of real estate service practitioners, the Department of Finance, and the CHED, shall prepare the necessary rules and regulations, including the Code of Ethics and Responsibilities for real estate service practitioners, needed to implement the provisions of this Act."

The Real Estate Service Industry should therefore look forward now to the eventual implementation of RA 9646 soonest as the process of creation of the Professional Regulatory Board of Real Estate Service is in full gear as the Professional Regulation Commission has recognized the Federation of Real Estate Associations as an Interim Accredited Professional Organization [ FRESA ] the last week of November 2009 , which has also provided already the names of the Nominees for the Real Estate Service Board.

DTI gives up licensing for real estate

THE Department of Trade and Industry (DTI) has transferred the regulation of real estate practice to the Professional Regulation Commission (PRC), as provided under Republic Act (RA) 9646, or the Real Estate Service Act of the Philippines.

“As R.A .9646 repeals Section 3(e) of Act No. 2728, the law from which the DTI draws its authority to regulate the real estate service, thus we have to transfer of the function to the PRC,” Trade Undersecretary Zenaida Maglaya said in a statement.

According to Section 4 of R.A. 9646, “There is hereby created a Professional Regulatory Board of Real Estate Service . . . under the supervision and administrative control of the Professional Regulation Commission.”

Hence, the DTI will no longer accept applications for license, whether initial or renewal, of real estate appraisers, brokers, consultants and salespersons beginning July 30, the agency said. Under R.A. 9646’s Section 17, the PRC will now issue the Certificate of Registration and Professional Identification Card of real estate practitioners.

Also, R.A. 9646 directed the DTI’s Bureau of Trade Regulation and Consumer Protection to transfer to the PRC all pertinent records from DTI field offices pertaining to licensed practitioners.

But the DTI said cases filed before the agency involving violation of the earlier Act 2728, whether pending or those that are filed prior to the effectivity of R.A. 9646, will still be acted upon accordingly.
