Supreme Court Decision : Developers covered by RESA, upholds its constitutionality
The Supreme Court
Decision promulgated last February 4, 2014 denying the
petition of the petitioners below and ruled that R.A 9646 is valid and constitutional
and upholding more specifically, Sec. 28(a) of the RESA, meaning that the
developers are not exempted
from being considered as engaged in the practice of real estate service and
their salespersons and brokers must comply with the requirements and provisions
of the RESA.
